Michael Jordan Testifies He Felt No Fear of Nascar in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer motivated his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Team Investment and a Competitive Drive

The owner disclosed operational insights of his racing venture, revealing he invested $40 million of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan said during testimony. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

The Core Dispute: Franchise System and Contract Pressure

The heart of the case involves the end of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other major leagues with separately owned franchises, such as the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a glimpse or a photo of the sports legend.

Spearheading the Fight

23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan said is unlawful to maintain excessive control.

At issue for Jordan and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a hectic and tense six hours where the racing circuit told teams they had to sign a contract extension. The document consists of 112 pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.

The team owners reached out to Nascar about potential amendments or extension options. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Winning

But in the end, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.

“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I dove in.”

Gibbs described her push for indefinite franchises, which she said a written letter to Nascar. She said the timing of the signature deadline was problematic.

She said, the team founder first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted was the message to Nascar’s executives. The response was, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
